Terms of Service

1. Overview

These Terms of Service ("Terms") govern your use of Coltura's website design, build, and care plan services. By engaging Coltura ("we", "us", "our") for a project, you ("the client", "you") agree to these terms.

2. Website Build Service

Scope: The website package includes the pages, features, and content specified in your chosen package at the time of booking.
Timeline: First draft delivered within 7 days of receiving all required content and materials from you. Delays in providing content will delay delivery.
Revisions: Unlimited revisions within the agreed package scope during the build phase. Revisions outside scope may incur additional charges.
Content: You are responsible for providing accurate business information, images, and any required branding assets. We can advise but are not liable for inaccurate information you supply.

3. Ownership & Intellectual Property

You own your website. Upon full payment of the build fee, you own the design, code, copy, and images created specifically for your website.
You own your domain. Domains are registered in your name with your chosen registrar. You retain full ownership and control.
Third-party assets: Any stock images, fonts, or libraries used are licensed appropriately. We ensure all assets used are properly licensed for commercial use.
Portfolio rights: We reserve the right to display your completed website in our portfolio and case studies unless you request otherwise in writing.

4. Included Care & Ongoing Maintenance

What's included with The Whole Thing (£2,500): 5-page website plus 24 months of hosting, SSL, unlimited updates, monthly site checkups, monthly backups, and 48-hour update turnaround.
After 2 years: £99/month for The Whole Thing. For The Forever Site (£3,500), £99/month after 3 years. Billed monthly. No long-term contract. Cancel anytime.

5. Cancellation & Offboarding

You can cancel anytime. The care plan is month-to-month with no minimum term and no exit fees.
You keep everything. On cancellation, we provide a full export of your website files within 14 days. Your domain remains yours — it was always registered in your name.
No lock-in. You are free to move your site to another developer or hosting provider at any time. We will assist with the transfer.
Refunds: Build fees are non-refundable once work has commenced. Care plan fees are non-refundable for the current billing month.

6. Payment Terms

Website build: 50% deposit to begin work, 50% on completion before launch. Full payment required before the site goes live.
Care plan: First payment on launch day, then monthly on the same date.
Late payment: We reserve the right to pause care plan services if payment is more than 14 days overdue.

7. Limitation of Liability

We build websites to the best of our ability using modern, professional practices. However, we cannot guarantee specific business outcomes, search engine rankings, or revenue increases.
We are not liable for content you provide that may be inaccurate, misleading, or infringe third-party rights.
Our total liability for any claim is limited to the total fees you have paid us in the 12 months preceding the claim.

9. Changes to These Terms

We may update these terms occasionally. Active clients will be notified of material changes via email. Continued use of our services after changes constitutes acceptance.
